ORDINANCE NO. 88, 2ND SERIES
AN ORDINANCE OF THE CITY OF ADRIAN, MINNESOTA, AMENDING ADRIAN CITY CODE, CHAPTER 3 ENTITLED “MUNICIPAL UTILITIES – RULES AND REGULATIONS” BY ADDING TO DEFINITIONS IN SECTION 3.01; BY ADDING TO, AND MAKING CHANGES TO, RULES AND REGULATIONS RELATING TO PRIVATE WATER SERVICE IN SECTION 3.40; AND, BY ADOPTING BY REFERENCE, CITY CODE CHAPTER l AND SECTION 3.99 WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS.
THE CITY COUNCIL OF THE CITY OF ADRIAN, MINNESOTA, DOES ORDAIN AS FOLLOWS:
Section 1. City Code Section 3.01 is hereby amended, to read and include:
Sec. 3.01. Definitions. Unless the context clearly indicates otherwise, the following words and terms shall have the meaning set forth below;
5. “Person” means any natural person, partnership, association, or private/public corporation
6. “Private Water Supply System” means a system owned and operated by a person for the collection and use of groundwater resources, also referred to as a ‘Private Well’.
7. “Public Water and Supply System” means the City of Adrian’s water supply.
Section 2. City Code Section 3.40 is hereby amended to include:

Subd. 5. Water Supplies
C. Private Water Supply Uses. The City allows the use of private water supplies (well(s), in existence prior to January 1, 2017, for irrigation. Use includes the sprinkling of lawns and gardens, car washing, air conditioning and other uses; only if such use is in compliance with the Minnesota Department of Health regulations, Minnesota Department of Natural Resources water appropriation permits, as applicable, and the City’s ‘Water Level Monitoring Plan’.
D. Special Well Administration Zone. A special well administration zone is hereby established. This zone is bounded by Pearl Avenue (County Hwy #35) on the South, Maine Street (State Hwy #91) on the West, Interstate 90 to the North and by the Adrian City Limits to the East. Within this zone, the ground water resources are dedicated to the City’s water supply system.
E. Private Water Supply. No person shall build, establish or expand a private water supply system within the City of Adrian
Section 3. City Code Chapter 1 entitled “General Provisions and Definitions Applicable to the Entire City code including penalty for violation” and Section 3.99 entitled “Violation a Misdemeanor” are hereby adopted in their entirety, by reference, as though repeated verbatim herein.
