ORDINANCE NO. 86, 2ND SERIES

AN ORDINANCE OF THE CITY OF ADRIAN, MINNESOTA, AMENDING ADRIAN CITY CODE, CHAPTER 10, ENTITLED “PUBLIC PROTECTION, CRIMES, AND OFFENSES”, SECTION 10.21 TITLED “ANIMALS AND FOWL – KEEPING, TRANSPORTING, TREATMENT, HOUSING”; BY CHANGING SUBD 1 RELATING TO DEFINITIONS AND ADDING SUBD. 7 RELATING TO LAYING HENS; AND BY ADOPTING REFERENCE, CITY CODE CHAPTER 1 AND SECTION 10.99 WHICH, AMONG OTHER THINGS, CONTAIN PENALTY PROVISIONS

THE CITY COUNCIL OF THE CITY OF ADRIAN, MINNESOTA, DOES ORDAIN AS FOLLOWS:

Section 1.  City Code, Chapter 10, Section 10.21, Subd. 1 entitled “Definition” is hereby amended by changing and/or adding definitions for:

 “Farm Animals” – Cattle, horses, mules, sheep, goats, swine, ponies, ducks, geese, turkeys, chicken roosters and meat-producing hens, guinea hens, and honey bees.

 “Animals” – Includes farm animals and all other animals, reptiles, and feathered birds or fowl except: dogs, cats, gerbils, hamsters, rabbits, laying chicken hens, and caged-household birds.

 “Laying Hen” means a domesticated female, none-clucking chicken that serves as a source of eggs.

“Meat-Producing Hen” means a domesticated female chicken that serves as a source of meat for consumption

 “Coop” means the structure for the keeping or housing of Laying Hens permitted by the ordinance.

F.   “Rooster” means a male chicken

Section 2. City Code, Chapter 10, Section 10.21, Subd. 7 entitled “Laying Hens and Chicken Coops” is hereby added:

 Egg Production. Laying hens are allowed in single-family residential areas for the sole consumption purposes of that residential household.  All Roosters and meat-producing or clucking hens are prohibited from being kept in the City.

 Number of Animals Restricted. No more than six (6) hens shall be housed or kept at any one (1) single-family residential parcel in any area of the City.

  Chicken Coops.  A coop is required to house the chickens.  Laying Hens must not be housed in residential homes or attached garages.  A coop must be constructed and maintained in the rear of the property within its own structure or as part of another structure that is not attached to the household dwelling.  The coop must be setback at least five (5) feet from the rear or side property lines.  The coop must be constructed with one (1) opening window per ten (10) square feet of floor space.  The coop will be constructed in a manner to not attract: rodents, insects, and/or other pests.

  Treatment of Laying Hens.  Each Laying Hen will be housed in a coop that allows four (4) square feet per bird.  The coop shall receive adequate ventilation while being controlled between 32-85 degrees Fahrenheit.  Each Laying Hen will be supplied with adequate bedding and the resulting manure will not accumulate to the depth of one (1) inch anywhere within the coop.  Failure to comply with these conditions may result in a law officer ordering the removing of chickens from the premises.

  Egg-Laying Production and the Potential of a Nuisance.  Hens shall not be kept in such a manner as to constitute a nuisance to the public or the occupants of adjacent properties.  All premises on which hens are kept or maintained shall be kept clean from filth, garbage, and any substances which could attract rodents, insects, and/or other pests. The coop and its surrounding area must be cleaned frequently enough to eliminate odor. Manure shall not be allowed to accumulate in a way that causes an unsanitary condition or causes odors detectible outside of the coop. Noise from the chickens shall not be detectible from outside of the coop.  Dead chickens must be disposed of according to the Minnesota Board of Animal Health rules which require chicken carcasses to be disposed of as soon as possible after death; usually within forty-eight (48) to seventy-two (72) hours.  Failure to comply with these conditions may result in the law officer ordering the removal of chickens from the premises. 

Section 3.  City Code Chapter 1 entitled “General Provisions and Definitions Applicable to the Entire City Code Including Penalty for Violation” and Section 10.99 entitled “Violation a Misdemeanor” are hereby adopted in their entirety, by reference, as though repeated verbatim herein.
