Eleanor M. Ashmore, Raymond D.  Ashmore, Joyce E. Tilden, Neil Tilden,

and all other unknown persons claiming any right, title, estate, interest or lien in the real estate described in the complaint herein.

Defendants.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:

You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court within twenty (20) days after service of this Summons upon you, exclusive of the day of service.  If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint.

This action involves, affects, or brings into question real property in the County of Nobles, State of Minnesota described as follows:

That part of the South Half of the Southwest Quarter and the South Half of the Southeast Quarter of Section 1, Township 101 North, Range 39 West, Nobles County, Minnesota,  described as follows:  Beginning at the Southwest corner of Section 1; thence on an assumed bearing of North 3 degrees 44 minutes 19 seconds East, along the west line of said section, a distance 1340.25 feet to the Northwest corner of the South Half of the Southwest Quarter of said section; thence South 89 degrees 23 minutes 33 seconds East,  along the north line of the South Half of the Southwest Quarter of said section a distance of 2658.78 feet to the Northeast corner of said South Half of the Southwest Quarter; thence south 3 degrees 33 minutes 34 seconds West, along the north-south quarter line of said  section, a distance of 854 feet, more or less, to centerline of a drainage ditch; thence southeasterly, easterly and northeasterly along said centerline, a distance of 1385 feet,  more or less, to the Intersection with the centerline of another drainage ditch, thence  southeasterly, along the centerline of said drainage ditch, a distance of 688 feet, more or less, to the south line of said Section 1; thence, North 89 degrees 37 minutes 20 seconds West, along said south line a distance of 1803 feet, more or less, to the South Quarter corner of said section, thence North 89 degrees 40 minutes 25 seconds West along said south line, a distance of 2663.68 feet to the point of beginning, containing 97.0 acres, more or less, subject to easements now of record in said county and state.

NOTICE IS FURTHER  GIVEN that the object of said action is to obtain a judgment declaring that Plaintiffs are the owners in fee of the property described above, and that the Defendants, and each of them, have no right, title, estate, interest or lien in or upon said property.

NOTICE IS FURTHER GIVEN that no personal claim is made by Plaintiffs against any of the Defendants.  However, if any Defendant unreasonably defends the action, Plaintiffs are requesting an order of the Court directing that said Defendant pay full costs to the Plaintiffs pursuant to Minn. Stat.  557.03.

ALTERNATIVE DISPUTE RESOLUTION.  The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice.  You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.
