vs.

Marion K. Habben and all other unknown heirs of Marion K. Habben and other persons claiming any right, title, estate, interest or lien in the real estate described in the complaint herein.

Defendants.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:

You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court within twenty (20) days after service of this Summons upon you, exclusive of the day of service.  If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint.

This action involves, affects, or brings into question real property in the County of Nobles, State of Minnesota described as follows:

That part of the South 150 feet of Lots 13 and 14, Block 53, Second Addition to the City of Worthington, Nobles County, Minnesota described as follows: Commencing at the Southwest corner of said Lot 13, thence on an assumed bearing of North 90˚ 00’00” East, along the south line of said Lot 13, a distance of 75.50 feet to an iron monument, said iron monument being the point of beginning of the tract to be described; thence North 0˚ 00” 00” East a distance of 41.60 feet to the centerline of a common wall; thence continuing North 0˚ 00’ 00” East, along the centerline of said common wall, a distance of 27.70 feet; thence continuing North 0˚ 00’ 00” East a distance of 80.70 feet to an iron monument a distance of 74.47 feet east of the Northwest corner of  said Lot 13; thence North 90˚ 00” 00” East, along the north line of  the South 150 feet of said Lots 13 and 14, a distance of 75.53 feet; thence South 0˚ 23’ 37” West a distance of 150.00 feet to an iron monument located on the south line of said Lot 14; thence South 90˚ 00’ 00” West, along the south line of said Lots 14 and 13, a distance of 74.50 feet to the point of beginning.

NOTICE IS FURTHER  GIVEN that the object of said action is to obtain a judgment declaring that Plaintiffs are the owners in fee of the property described above, and that the Defendants, and each of them, have no right, title estate, interest or lien in or upon said property.

NOTICE IS FURTHER GIVEN that no personal claim is made by Plaintiffs against any of the Defendants.  However, if any Defendant unreasonably defends the action, Plaintiffs are requesting an order of the Court directing that said Defendant pay full costs to the Plaintiffs pursuant to Minn. Stat.  557.03.

ALTERNATIVE DISPUTE RESOLUTION.  The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice.  You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.
