Joyce Broesder and Nicole Platt, Trustees

of the JJB Trust and JCB Trust,

Plaintiffs, SUMMONS

vs.

Donald Bullerman, individually and as co-trustee of the Donald Bullerman Trust, Mark Bullerman, individually

and as co-trustee of the Donald Bullerman Trust and Nyla Bullerman Trust, any successor trustees of either trust, and all other persons unknown claiming any right, title, estate, interest or lien in the real estate described the complaint herein.

Defendants.

THE STATE OF MINNESOTA TO THE ABOVE-NAMED DEFENDANTS:

You are hereby summoned and required to serve upon Plaintiffs’ attorney an Answer to the Complaint which is on file in the office of the Court Administrator of the above-named Court within twenty (20) days after service of this Summons upon you, exclusive of the day of service.  If you fail to do so, judgment by default will be taken against you for the relief demanded in the complaint.

This action involves, affects, or brings into question real property in the County of Nobles, State of Minnesota described as follows:

A tract of land in the West Half of the Southwest Quarter (W½SW¼) of Section 6, Township 102, Range 42, described as follows: Commencing at the Southwesterly corner of the SW ¼  of Section 6, Township 102 Range 42; thence North on the West line of said section a  distance of 274 feet; thence Easterly and parallel to the South Section line a distance of 590 feet; thence at right angles southerly and parallel to the west line of said section a distance of 274 feet; thence Westerly and parallel to the South Section line a distance of 590 feet to the place of beginning.

NOTICE IS FURTHER  GIVEN that the object of said action is to obtain a judgment declaring that Plaintiffs are the owners in fee of the property described above, and that the Defendants, and each of them, have no right, title estate, interest or lien in or upon said property.

NOTICE IS FURTHER GIVEN that no personal claim is made by Plaintiffs against any of the Defendants.  However, if any Defendant unreasonably defends the action, Plaintiffs are requesting an order of the Court directing that said Defendant pay full costs to the Plaintiffs pursuant to Minn. Stat.  557.03.

ALTERNATIVE DISPUTE RESOLUTION.  The parties may agree to or be ordered to participate in an alternative dispute resolution process under Rule 114 of the Minnesota General Rules of Practice.  You must still send your written response to the Complaint even if you expect to use alternative means of resolving this dispute.
